ACLU representative says the new Raleigh County policy could lead to a day in court.

By Alicia Suka

BECKLEY- --  A member of the American Civil Liberties Union warned the Raleigh County Commission - its random drug testing could lead to a lawsuit.

Seth DiStefano with the ACLU challenged the policy with the commission at its regular meeting Tuesday.

As of earlier this month, all Raleigh County employees are subject to drug testing.

DiStefano says the policy could unfairly test applicants who are qualified for county positions.

He provided possible scenarios to the commission.

"Someone may have a problem with having their urine inspected to have a job and will so no and upon them saying no and exercising their fourth amendment right will be denied a job immediately and I think the county could run into problems with that in the future," said DiStefano.

The Fourth Amendment protects people from unreasonable and unwarranted search and seizure.

The Raleigh County Commission stood by the new drug testing policy.

There is no litigation pending against the county regarding its drug testing program.

Well 30% of drug test prove to be false positives. Should we throw the baby out with the bath water and if we do where will it stop!

I think this drug testing our state employees is an excellent idea, in spite of what others might say. Would you want someone high on drugs or alcohol teaching your children or transporting them to and from school? Better think before you answer.

Within the last couple of years I've seen stories in the media about a drunk school bus driver driving his bus [full of children] over an embankment. Thank God the children were not seriously injured.

I also am well aware of not one but TWO fayette county school teachers that were involved in serious drug activities. One was caught with over a kilo of coke in his personal vehicle, the other was running a meth lab from home.

Our children are our future. Nuff said?
